SB 426 (Leslie) - Repeals California's "Truth in Environmental Advertising"
law. This law requires that manufacturers meet clearly defined minimum
standards to advertise their product or packaging as "recycled," "ozone
friendly" or "biodegradable." Specifically, the term "recycled" cannot be used
unless the product or package meets a minimum standard of 10% post-consumer
content. SB 426 would repeal these standards which have served to protect
consumers from false claims made by manufacturers and advertisers.
California's Truth in Environmental Advertising law has been successful in
curbing the misuse of the terms "recycled," "ozone friendly" and
"biodegradable," as well as blatant use of false environmental claims by
product makers and advertisers. The motive behind the sponsors of SB 426 is to
allow products that contain zero post-consumer recycled content to be labeled
"recycled." These manufacturers want to paint themselves "green" without
helping to create markets for waste paper collected for recycling.
Status - SB 426 narrowly passed out of the Senate on May 23. It will be heard
in the Assembly Committee on Consumer Protection on Tuesday, June 27.
Action Needed - Please call or write to members of the Assembly Committee on
Consumer Protection expressing your opposition to this bill. Key members are
Speier (Chair), Davis, Firestone, Isenberg and Machado.

AB 1659 (Woods) - Administrative regulations (see LegAlert #10). Passed out of
the Assembly June 1. Scheduled for hearing June 27 in the Senate Governmental
Organization Committee.

SB 28 (Leslie) - Mountain lion hunting (see LegAlert #1). Passed out of the
Senate June 1. Scheduled for hearing June 28 in the Assembly Water, Parks and
Wildlife Committee.
Action needed - Call or write members of the Water, Parks and Wildlife
Committee, asking them to oppose SB 28. Members of the committee are Cortese
(Chair), Frusetta (Vice-Chair), Allen, Battin, Campbell, Cannella, Ducheny,
Hauser, Katz, K. Murray, Olberg, Poochigian, Setencich and Thompson.

AB 42 (Baca) - Hazardous materials (see LegAlert #10) and
AB 349 (Escutia) - Oil pipeline safety (see LegAlert #3). Both passed out of
the Assembly June 2. Scheduled for hearing July 3 in the Senate Toxics and
Public Safety Committee.
Action needed - Call or write members of the Toxics and Public Safety
Committee, asking them to oppose AB 42 and support AB 349. Members of the
committee are O'Connell (Chair), Wright (Vice-Chair), Hayden, Leonard, Peace,
Petris and Thompson.
