The California Legislature is in recess until August 21. Here's a look at the
significant environmental legislation that they'll be working in when they
return:
SB 1180 (Calderon) - California Environmental Quality Act (CEQA) - eliminates
the "fair argument" standard, Sierra Club opposes (see
LegAlert #15). SB 1180
is currently in the Assembly Natural Resources Committee. A hearing has not
yet been scheduled.
SB 649 (Costa) - Water Pollution - raises evidentiary standard for enforcement
against polluters under Section 5650 of the Fish and Game Code, Sierra Club
opposes (see
LegAlert #13). SB 649 was defeated by the Assembly Water, Parks
and Wildlife Committee on July 11, but may be reconsidered. A hearing has not
yet been scheduled.
SB 31 (Leslie) - Civil Liability - limits punitive damages to three times
actual damages, with a cap of $250,000., Sierra Club opposes. SB 31 will be
voted on by the full Assembly shortly after it reconvenes on August 21.
SB 426 (Leslie) - Environmental Advertising - repeals California's standards
for environmental labelling, Sierra Club opposes (see
LegAlert #16). SB 426
will be voted on by the full Assembly shortly after it reconvenes on August
21.
SB 28 (Leslie) - Mountain Lions - legislative ballot measure lifting the
moratorium on mountain lion hunting, Sierra Club opposes. SB 28 is scheduled
for hearing by the Assembly Appropriations Committee on August 23.
SB 1120 (Costa) - California Endangered Species Act (CESA) - decriminalizes
accidental take of listed species, Sierra Club opposes (see
LegAlert #14). SB

August 23.
AB 350 (Bustamante) - California Endangered Species Act (CESA) - raises
evidentiary standard for listing of species under CESA, Sierra Club opposes
(see
LegAlert #14). AB 350 is currently in the Senate Natural Resources
Committee. A hearing has not yet been scheduled.
AB 349 (Escutia) - Oil Pipeline Safety - creates a program for statewide
assessment of hazardous liquid pipelines, Sierra Club supports (see LegAlert
#3). AB 349 is currently in the Senate Appropriations Committee. A hearing has
not yet been scheduled.
We don't expect these bills to move before the Legislature recesses for the
year on September 15:
AB 1659 (Woods) - Administrative Regulations - Sierra Club opposes (see
LegAlert #13).
AB 1659 was defeated in the Senate Governmental Organization
Committee on July 11.
AB 42 (Baca) - Hazardous Materials - Sierra Club opposes (see LegAlert #10).
AB 42 was removed from consideration by the Senate Toxics Committee due to
widespread opposition.
AB 137 (Olberg) - California Endangered Species Act (CESA) - Sierra Club
opposes (see
LegAlert #14).
AB 137 was removed from consideration by the
Senate Natural Resources Committee.
SB 1177 (Killea) - California Endangered Species Act (CESA) - Sierra Club
supports (see LegAlert #14).
SB 1177 was removed from consideration by the
Assembly Water, Parks and Wildlife Committee.
AJR 6 (Olberg) - California Desert Protection Act Resolution - Sierra Club
opposes (see LegAlert #7). AJR 6 was removed from consideration by the
Assembly Natural Resources Committee.
AJR 16 (Setencich) - Federal Endangered Species Act Resolution - Sierra Club
opposes (see
LegAlert #13).
AJR 16 was removed from consideration by the
Senate Natural Resources Committee.
